Terms of Service

1. Agreement

By creating an account or using Waxseal ("the Service"), operated by Waxseal ("we", "us", "our"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Waxseal provides custom domain email hosting services including IMAP/SMTP email delivery, email group management, DNS verification, and a web management portal. The Service is provided on a subscription basis with tiered plans (Personal, Indie, Business).

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 16 years old to use the Service.

4. Free Trial

New accounts receive a 14-day free trial with full access to all features of the Personal plan. No credit card is required. After the trial period, you must subscribe to a paid plan to continue using the Service. Accounts that do not subscribe will be suspended 7 days after trial expiry.

5. Subscriptions and Billing

Subscriptions are billed monthly via Stripe. Plan changes take effect immediately with prorated billing. You may cancel at any time — cancellation takes effect at the end of the current billing period. We may change pricing with 30 days notice.

6. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk email (spam)
• Distribute malware, phishing, or fraudulent content
• Store or transmit illegal content
• Impersonate others or misrepresent your identity
• Attempt to gain unauthorized access to other accounts or systems
• Exceed your plan's usage limits through automated means
• Resell the Service without prior written agreement

Violation of these terms may result in immediate account suspension or termination.

7. Service Level

We target 99.9% uptime for email delivery and IMAP access. Scheduled maintenance will be announced at least 24 hours in advance. This is a target, not a contractual guarantee. We do not offer financial SLA credits at this time.

8. Data Retention

Mailbox data is retained for 30 days after account cancellation or suspension, after which it is permanently deleted. Backups are retained per our backup schedule (30 daily, 12 weekly, 12 monthly snapshots). You may request a data export at any time while your account is active.

9. Account Termination

You may delete your account at any time from the Settings page. We may suspend or terminate accounts that violate these terms. Termination follows this process: warning → 7-day grace period → suspension → 30-day data retention → permanent deletion.

10. Limitation of Liability

The Service is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim. This does not affect your statutory rights under applicable law.

11. Governing Law

These terms are governed by the laws of Japan. Any disputes shall be submitted to the exclusive jurisdiction of the Tokyo District Court.

12. Changes to These Terms

We may update these terms from time to time. Material changes will be notified via email to the address on your account at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
